Privacy Policy (Personal Data Processing Policy)

This policy describes how Propertia Realty collects, uses, stores and protects the personal data of people who visit the site, contact an advisor, register as agents or list a property, in accordance with Colombian Statutory Law 1581 of 2012, Decree 1377 of 2013 and Sole Regulatory Decree 1074 of 2015 (Title 2, Chapter 25).

1. Data controller

The data controller is Gregorio Quintero, a natural person identified with Colombian citizenship ID No. 1.130.623.233, doing business under the trade name “Propertia Realty”, domiciled at Carrera 52A # 6-45, Cali, Valle del Cauca, Colombia.

2. Definitions

• Personal data: any information linked or that may be associated with one or more identified or identifiable natural persons.
• Financial data: information about income, repayment capacity or credit bureau reports, voluntarily declared by the data subject during an indicative mortgage pre-qualification conversation (non-binding and not verified against any bank or official source).
• Data subject: the natural person whose data is processed (whoever browses the site, writes via WhatsApp, registers as an agent or lists a property).
• Data controller: Gregorio Quintero / Propertia Realty, who decides on the database and the purposes of processing.
• Data processor: a natural or legal person that processes personal data on behalf of the controller (see section 5).
• Processing: any operation on personal data, such as collection, storage, use, circulation or deletion.
• Authorization: the data subject's prior, express and informed consent to the processing of their data.

3. Data we collect

Depending on the channel you use, Propertia Realty may collect:

• Identification and contact data: name, email address and phone number (property listing forms, agent registration, and conversations with the Sales Advisor via WhatsApp).
• Content of conversations with the Sales Advisor (bot) and, where applicable, with Propertia's human staff.
• Search preferences: area, property type, number of bedrooms/bathrooms, budget and any non-negotiable criteria you indicate.
• Financial data declared for an indicative mortgage pre-qualification: declared monthly income, type of economic activity, length of employment, available down payment and self-reported credit bureau status. This data is self-reported by the data subject in the conversation; the resulting assessment is indicative and does not replace or guarantee an actual bank evaluation.
• Property and owner data when you list a property: location, expected price, features, age and encumbrances (mortgage, seizure, usufruct).
• Account data when you register as an agent: full name, email, phone, city and, optionally, agency name; if you use “Continue with Google”, we receive the name and email associated with that Google account.
• Technical browsing data through the tools described in section 5 (Google Tag Manager and Microsoft Clarity), subject to the cookie consent described in the Cookie Policy.

Propertia Realty does not collect sensitive data in the strict sense of Law 1581 of 2012 (health, religious beliefs, political orientation, etc.) as part of this operation.

4. Purposes of processing

• Handle and qualify your request to buy, rent or list a property.
• Search for and suggest properties from Propertia's catalog that match what you are looking for.
• Run an indicative (non-binding) mortgage pre-qualification.
• Produce the Comparative Market Analysis (CMA) for owners who list a property.
• Manage your agent account, if you register on the platform.
• Internal management of the business: reports, lead follow-up and customer service.
• Site analytics and improvement (only with your cookie consent — see section 5 and the Cookie Policy).

We do not use your data for third-party advertising, and we do not sell or transfer it to third parties outside the purposes described here.

5. Data processors and international transfer

Propertia Realty uses the following technology providers to operate the platform. Each acts as a data processor for the data it handles on behalf of the controller. Several process data on servers outside Colombia, which constitutes an international transmission of data under Law 1581 of 2012.

6. Data subject rights

As the owner of your personal data, you have the right to:

• Know, update and correct your personal data.
• Request proof of the authorization granted.
• Be informed, upon request, of how your data has been used.
• File complaints with the Superintendence of Industry and Commerce (SIC) for violations of the law.
• Revoke the authorization and/or request deletion of the data, when no legal or contractual duty prevents it.
• Access, free of charge, your personal data that has been processed.

7. How to exercise your rights

You can exercise any of these rights by writing to info@propertiarealty.com, stating your full name, the right you wish to exercise and a means of contact.

• Inquiries: answered within a maximum of ten (10) business days from receipt. If that is not possible, the data subject will be informed before the deadline of the reasons for the delay and the date on which it will be answered, which may not exceed five (5) business days after the first deadline.
• Claims: handled within a maximum of fifteen (15) business days from the day after receipt. If that is not possible, the data subject will be informed of the reasons for the delay and the date on which it will be handled, which may not exceed eight (8) business days after the first deadline.

8. Data of children and adolescents

Propertia Realty's services are intended for adults with legal capacity to buy, rent, invest in or list a property. We do not knowingly collect data from minors. If a parent or guardian finds that a minor in their care has provided us with personal data, they may request its immediate deletion by writing to info@propertiarealty.com.

9. Data retention

While there is an active business relationship (an ongoing conversation or an unresolved request), your data is kept with no additional time limit. An inactive lead is kept for up to 24 months from the last contact, after which it is purged or anonymized, unless a legal or contractual obligation requires keeping it longer (for example, a completed sale, rental or listing with ongoing accounting or tax obligations).

10. Security measures

Propertia Realty implements reasonable technical and administrative measures to protect your personal data against loss, misuse, unauthorized access, alteration or disclosure, including encrypted communication (HTTPS/TLS), individual access credentials for staff and isolation of the Sales Advisor from the main database.

11. National Database Registry (RNBD)

Law 1581 of 2012 requires controllers whose databases exceed certain thresholds to register with the RNBD of the Superintendence of Industry and Commerce. This point is pending validation by a specialized lawyer based on Propertia Realty's current number of data subjects.

12. Effective date and changes

This policy may be modified at any time. The current version will always be available at propertiarealty.com/privacy-policy (English) and propertiarealty.com/privacidad (Spanish).
